Beef on FDR turns deadly

In the wee hours of Sunday morning there was a motorcycle accident with fatalities on the FDR up on East 117th Street.

The FDR was backed up on both sides following the accident, and an argument erupted betwixt a man in a maroon Honda and a dude in a yellow Xterra.



Cars were being diverted off the FDR and onto First Avenue and East 117th Street. That's when the dude in the yellow SUV pulled out a gun and shot the dude in the maroon Honda in the chest.



The driver of the Honda managed to drive northbound for three more blocks from the spot of the shooting before pulling over at East 120th Street where he died at around 5:49 a.m.

The victim in the Honda was later identified as 25-year old Jayson Tirado. Jay lived in the Jacob Riis Houses on the Lower East Side with his mother and sister.

Responding paramedics said he had been shot in the torso. He was taken to Harlem Hospital, where he was pronounced dead on arrival.

OK so now I'm hearing the dude in the yellow Nissan Xterra may've been an off-duty cop.

Police Commissioner Ray Kelly says that the officer turned himself in early this morning. The officer, a 4-year veteran, is being questioned at the 25th Precinct, where charges are expected to be filed.

We're hearing the officer became involved in the dispute after Jayson Tirado refused to let him merge. The officer drove ahead and, when Tirado caught up with him, words were exchanged again.

A witness told police that Tirado had taunted the officer by acting like he had a gun; pointing his finger at the off-duty cop and pretended to shoot him.

Authorities believe the off-duty officer, fearing his safety, pulled out a real gun and opened fire.
